Riding a motorcycle always comes with risks, either you’re the driver or a passenger. In fact, being a passenger on a motorcycle is sometimes even more dangerous because you can’t really do anything to avoid the accident itself. This lack of control is a problem, but you’re just as likely to suffer the same types of serious injuries that happen in these accidents–many of which end up being fatal.
A story from the Spokesman-Review details a recent accident that resulted in the death of a female passenger on a motorcycle. According to the Spokane County Sheriff’s Office (SCSO), the accident happened around 7:10 p.m. on Friday, October 18, 2024. Deputies responded to the scene of the accident, near the 8900 block of North Fairview Road in Mead. Once they arrived, they found a man and woman lying on the ground with serious injuries. Spokane County Fire District 9 also responded, providing CPR at the scene. The woman was pronounced dead at the scene, while the driver of the motorcycle was transported to a local hospital.
SCSO’s initial investigation showed that speeding and potential impairment both played a part in the accident.
Can You File a Claim If You’re an Injured Passenger in a Motorcycle Accident?
You obviously never want to be in a motorcycle accident, whether you’re the driver or the passenger. But as far as your legal rights go, you can file a claim when you’re injured as a passenger the same way you could if you were in a car accident.
The main difference is that, in a motorcycle accident, you’ll most likely be filing against the person you’re riding with–and that can complicate things. Still, as the driver that was negligent and caused the accident, they’ll be liable for your damages. From there, you can either file:
- An insurance claim
- A personal injury lawsuit
When you file an insurance claim, it’s a quicker, less formal process that happens outside of court. You can receive a settlement faster, but the insurance company decides how much to give, and it’s often less than you need. You can either accept this offer to end the process or choose to go to court.
A lawsuit is a more involved process that happens within the court system. While it takes more time and effort, it can result in much higher compensation, known as “damages.” In this case, a judge and jury decide the final amount based on factors like:
- Medical expenses
- Lost income or reduced earning ability
- Pain and suffering
- Emotional distress
- Repair or replacement costs for damaged property
- Loss of companionship or quality of life
- Costs related to wrongful death
