Such differences relate to the admissibility of evidence, what counts as a prior conviction for DUI, when a person may be charged with a felony DUI, and how long you have to request a license suspension hearing. While it’s not possible to relate all the driving under the influence laws and issues that may arise in any particular case, some Idaho DUI laws can be summarized here:

First DUI:

  • misdemeanor violation
  • jail 0 to 6 months
  • fines up to $1000
  • license suspension 90-180 days

Second DUI within 10 years:

  • misdemeanor violation
  • Jail 10 days to one year
  • fines up to $2000
  • license suspension one year mandatory after release from custody with no driving privileges of any kind
  • mandatory ignition interlock

Third DUI within 10 years:

  • felony violation
  • jail 30 days mandatory up to five years fines up to $5000
  • license suspension up to five years one year mandatory after release from custody with no driving privileges of any kind
  • mandatory ignition interlock

Blood level .02% or greater – first offense:

  • misdemeanor jail 10 days mandatory up to a year
  • fines up to $2000
  • license suspension one year mandatory after release from custody with no driving privileges of any kind

blood level .02% or greater – second offense within five years:

  • felony violation jail mandatory 30 days in county jail or up to five years in state penitentiary
  • fines up to $5000
  • license suspension up to five years, one year mandatory after release from confinement with no driving privileges of any kind
  • mandatory ignition interlock

In addition to criminal charges, the Idaho Transportation Department will attempt to suspend your license through civil proceedings. You will have seven days to submit a request to contest the suspension, and could face a suspension starting at 90 days, depending on the type of DUI charge.
